Boots & Image Photo Competition – Ireland

Terms and Conditions:

• Entrants to this competition must be aged 18 or over and a resident in the Republic of Ireland.

• Employees and the immediate families of [BOOTS Ireland (hereinafter referred to as ?BOOTS?], their agents, or anyone professionally connected with this competition are not entitled to enter.

• The competition begins at 0800 on Thursday 13^th August 2015 and closes at midnight on Wednesday 16^th September 2015. BOOTS reserves the right to adjust the start and end dates of this competition without prior notice.

• This competition is free to enter. [OPTIONAL STATEMENT – Only one entry per person and/or social account].

• Responsibility will not be accepted for loss, delay and corruption of any data in transit or in the incomplete nature of any entries to the competition.

• All entrants agree to their names and comments being used for promotional purposes.
• Uploading of photographs of pornographic, profane, sexist, defamatory, vulgar and racist nature are prohibited and BOOTS reserves the right to delete such pictures from its Facebook site.

• Prizes – the following winners of the competition will be selected on Friday 18^th September 2015 from all eligible entries. The prizes are as follows:?

1^st place – €200 and the 1^st place winner’s photograph printed on a photo canvas and his or her photograph featured in a press campaign

2^nd Place – €150 and the 2nd place winner’s photograph printed on a photo cushion and his or her photograph featured in a press campaign

3^rd Place – €50 and the 3rd place winner’s photograph printed on a photo mug and his or her photograph featured in a press campaign

The remaining 10 winners – each of their photographs printed on a photo mug and their photographs featured in a press campaign

• In the event that you have been selected as a winner, you shall execute a confirmatory formal copyright licence agreement in favour of [BOOTS] under similar terms as outlined in these terms and conditions. In the event that you fail to execute and return the confirmatory formal copyright licence agreement within [ONE WEEK] of receipt of such agreement [BOOTS] reserves the right to withdraw from awarding the prize to you a may award it to another entrant.?

• All winners will be notified via Facebook or Instagram. This must be acknowledged by the winner, via Facebook or Instagram, within 72 hours. Failure to respond to this Facebook or Instagram message means an alternative winner will be selected from all valid entries received. Winners will be asked to provide contact details for the purposes of awarding the prize only.

• [BOOTS] reserves the right in their reasonable discretion to substitute any such prize or item with a prize or item of equal value or greater.?

• By submitting photos to Boots Ireland Digital and Social Media Team you confirm that for each photo submitted
• You are the only author of your work and that it is your original work
• You are the sole copyright holder
• You have not licensed any rights in the work that will conflict with the usage / image rights required by [BOOTS]
• You have the permission of any persons in the work, or if they are under 16, the consent of their parent or guardian to grant the usage/image rights required by [BOOTS]
• That it does not include any other intellectual property rights of any other third person or entity
• That it does not contain names, likenesses, or other characteristics identifying celebrities or other public figures, living or dead

• You will be responsible for any claim made by any third party in respect of your entry and to fully indemnify [BOOTS] and [its co-organiser IMAGE MAGAZINE {INSERT FULL LEGAL NAME OF IMAGE MAGAZINE}] in respect of all royalties, fees and any other monies owing to any person or entity by reason of your breaching any of the foregoing

• [BOOTS] respects photographers? rights and does not claim copyright ownership over photographs submitted to this contest, you the author retain full copyright ownership in each entry.?

• You waive (and to the extent that you cannot waive agree irrevocably not to assert) any and all moral rights to which you may be entitled anywhere in the world in respect of your photograph.?

• You affirm, represent and warrant that you have the power and authority to, and do, grant to [BOOTS] an irrevocable, unrestricted, worldwide, non-exclusive, royalty free, sublicensable and transferable licence to copy, publish, reproduce, distribute, store, modify, adapt, display and to use in any way your photograph or parts thereof. This licence grant includes, but is not limited the following purposes :

• editorial purposes;
• trade purposes;
• advertising purposes;
• promotional purposes;
• commercial purposes;
• non-commercial purposes; or
• any other purpose.

• You confirm that your photograph may be used by [BOOTS] in any medium throughout the world including, without limitation, printed publications, presentations, promotional materials, television, cinema or the Internet, in its original format or edited or altered in any way which [BOOTS] deems appropriate.

• Entrants will be deemed to have accepted these rules and to agree to be bound by them.

• We will not pass on your personal details to any other organisation without your permission, except for the purpose of awarding the prize if necessary.
